Estate Administration

Estate administration begins the probate process. It is essentially the process of collecting assets, paying debts, and distributing the decedent’s estate to the rightful heirs (i.e., beneficiaries). Probate laws require your estate’s representative to take inventory of all assets within the estate and maintain those assets prior to distribution to the beneficiaries.

Once the estate’s Executor (the personal representative of the estate) receives the court’s permission to do so, the Executor will notify and pay the creditors, as well as any taxes associated with the estate. After the creditors and taxes have been paid, the Executor then distributes the remaining assets to the rightful heirs and beneficiaries in accordance with the probated Will or court-ordered distribution. It is the Executor’s sole responsibility to locate all of the potential heirs and beneficiaries, as well as ensure that each receives their rightful inheritance.
